en banc Defendant Marion Redmond was convicted of second degree murder, § 565.021, 1 and armed criminal action, § 571.015, for which he was sentenced to concurrent terms of thirty years and three years, respectively. On appeal, Redmond's principal contention was that the trial court erred in refusing to instruct the jury on voluntary and involuntary manslaughter. The Missouri Court of Appeals, Eastern District, affirmed, with one Judge Dissenting. The case was transferred upon the Dissenting Judge's certification that he deemed the majority opinion to be contrary to State v. Newlon, 721 S.W.2d 89 (Mo. App. 1986). Rule 83.01. Because of the trial court's failure to give the requested voluntary manslaughter instruction, the judgment of the trial court is reversed and the cause remanded for a new trial. I.
